Law enforcement is trained to detect drivers that are under the influence of alcohol, cannabis and/or drugs, including prescription medications, some over-the-counter (OTC) medications and illegal drugs.

It is unlawful for a person who is under the influence of any alcoholic beverage or drug, or the combined influence of an alcoholic beverage or drug, to drive a vehicle.

Even One Drink Can Make You an Unsafe Driver
In California, driving with a Blood Alcohol Concentration (BAC)** of 0.08% or more (0.04% or more if you drive a commercial vehicle; 0.01% or more if under 21) is presumed illegal. However, you could be determined under the influence even at a lower BAC. Predictable BAC effects on driving:
Decline in visual functions, decline in ability to perform two tasks at the same time.
Reduced coordination, reduced ability to track moving objects, difficulty steering, reduced response to emergency driving situations.
Lack of concentration, short-term memory loss, reduced information processing capability, impaired perception.

Implied Consent
Anyone who drives in California is presumed to have given their consent to provide a chemical test to measure the alcohol and/or drug content of their blood.

A person with a BAC of .08% is presumed to be under the influence of alcohol, but even at a lower BAC, a person may still be arrested if they are impaired.
Ignition Interlock Device
Depending on the circumstances of the violation, persons arrested for DUI may be required to install an ignition interlock device.
DUI Sobriety Checkpoints
The CHP conducts sobriety checkpoints to deter impaired driving and to remove impaired drivers from the roadway in an effort to save lives.
Commercial DUI
It is illegal for a driver to operate a commercial vehicle with a blood alcohol reading of 0.04% or higher. A commercial driver will be put out of services with a BAC of .01% or higher.
License Suspension or Revocation
A person arrested for driving under the influence may have their driver’s license suspended or revoked. Additionally, persons under the age of 21 not arrested for DUI with a measurable BAC may have their driver’s license suspended or revoked.
Open Container of Alcohol
It is illegal for an owner or driver to keep an open container of alcohol in a vehicle except in the trunk or other area out of the immediate control of the occupants. It is also unlawful for passengers to possess an open container of alcohol.
